1. Acceptance of Terms
Welcome to Recapfy. These Terms of Service ("Terms") govern your access to and use of the Recapfy mobile application and web service (collectively, the "Service"), operated by Pedro Teixeira, an individual/sole proprietor based in Portugal, European Union.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
You must be at least 16 years old to use this Service. By using the Service, you represent that you are at least 16 years of age.
2. Description of Service
Recapfy is a YouTube video summarization service that:
•
Connects to your YouTube account via Google OAuth
•
Accesses your YouTube channel subscriptions
•
Retrieves video information from channels you subscribe to
•
Generates AI-powered summaries of YouTube videos using third-party AI services, based on independently-sourced video transcripts (not data from Google APIs)
•
Provides quota-based access to summarization features based on subscription tiers
The Service is available on iOS, Android, and web platforms.
3. User Accounts
3.1 Account Creation
To use the Service, you must create an account by providing:
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Account Security
You agree to:

Provide accurate and complete information when creating your account
•
Keep your password secure and confidential
•
Notify us immediately of any unauthorized use of your account
•
Not share your account with others
3.3 Account Termination
You may delete your account at any time through the Profile page in the app. We may suspend or terminate your account if you violate these Terms.
4. Google OAuth Authorization
To use Recapfy's core features, you must authorize us to access your YouTube data via Google OAuth.
4.1 Scope of Access
By connecting your YouTube account, you grant Recapfy permission to:

View your YouTube channel subscriptions
•
Access video metadata from channels you subscribe to (titles, descriptions, thumbnails, upload dates)
We only request read-only access (youtube.readonly scope). We cannot modify your YouTube account, upload videos, or access your private viewing history.
4.2 Revocation Rights
You may revoke Recapfy's access to your YouTube data at any time through:

Recapfy Profile page: "Disconnect YouTube Account" option
4.3 Compliance with Google Policies
Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
5. Acceptable Use Policy
You agree NOT to use the Service to:
•
Violate YouTube's Terms of Service or Community Guidelines
•
Share your account credentials with others
•
Use automated tools, bots, or scripts to access the Service
•
Reverse engineer, decompile, or disassemble any part of the Service
•
Attempt to circumvent quota limitations or subscription tiers
•
Access or summarize content that violates applicable laws
•
Harass, abuse, or harm other users
•
Interfere with or disrupt the Service or servers
•
Use the Service for any illegal or unauthorized purpose
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account.
6. Subscription Tiers and Quotas
6.1 Service Tiers
Recapfy offers different subscription tiers:
•
FreePlan: Limited number of video summaries per month
•
StarterPlan: Increased monthly quota
•
ExpertPlan: Higher monthly quota for power users
Specific quota limits are displayed in your Profile page within the app.
6.2 Quota Usage
Your monthly quota resets on the date specified in your Profile. Unused quota does not roll over to the next month.
6.3 Fair Use Policy
We reserve the right to limit excessive use that negatively impacts our Service or violates the spirit of your subscription tier.
7. Service Availability
We strive to maintain reliable service availability, but we do not guarantee:

Uninterrupted access to the Service
•
That the Service will meet your specific requirements
•
Availability of the Service at all times
We may modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.
8. Intellectual Property
8.1 Your Data
You retain all rights to your account data, including your email, preferences, and any content you provide.
8.2 Generated Summaries
AI-generated video summaries created through the Service are provided to you for your personal use. You may use these summaries for personal, non-commercial purposes.
Summaries are retained for 30 days after creation and are automatically deleted thereafter. You are responsible for saving or exporting any summaries you wish to keep before they are deleted.
8.3 Recapfy Platform
Recapfy, including its software, design, branding, and underlying technology, is owned by Pedro Teixeira and protected by intellectual property laws.
8.4 YouTube Content
All YouTube videos, metadata, and related content remain the property of their respective creators and are subject to YouTube's Terms of Service.
9. Third-Party Services
Recapfy integrates with third-party services, including:
•
Google OAuth and YouTube Data API v3
•
Publicly available transcript services for obtaining video transcripts independently of Google APIs
•
Third-party AI services for summary generation (see current providers below)
Your use of these third-party services is subject to their respective terms and conditions:

We are not responsible for the availability, functionality, or practices of third-party services.
Recapfy maintains strict data segregation between these services. Data obtained from Google APIs (such as YouTube subscriptions and video metadata) is used solely for display within the app and is never shared with any AI service provider. When generating summaries, the AI service only receives video transcripts obtained independently from publicly available sources, ensuring complete isolation from Google API data.
Current AI Service Providers:

xAI (Grok) — used for generating video summaries
10. Subscription and Payment
Recapfy offers both free and paid subscription tiers. For paid subscriptions:
•
All payments are processed securely through Stripe
•
Subscription fees are billed monthly in advance
•
Prices are displayed in USD and are subject to change with 30 days notice
•
You can cancel your subscription at any time through your Profile page
For information about refunds and cancellations, please refer to our Refund Policy. By subscribing to a paid plan, you agree to the terms outlined in both these Terms of Service and our Refund Policy.
11. Account Termination
11.1 Termination by You
You may delete your account at any time through the Profile page. Upon deletion:

Your account will be permanently deleted
•
All summaries and data will be removed from our servers
•
OAuth access to your YouTube account will be revoked
•
This action cannot be undone
11.2 Termination by Recapfy
We may suspend or terminate your account if you:
•
Violate these Terms of Service
•
Engage in fraudulent or illegal activities
•
Abuse the Service or other users
•
Fail to comply with applicable laws
We will provide notice when possible, but we reserve the right to terminate accounts immediately for serious violations.
12. Disclaimers
12.1 AI-Generated Content
Video summaries are generated using third-party artificial intelligence services, based on video transcripts obtained independently from publicly available sources (not via Google APIs). While we strive for accuracy:

Summaries may contain errors or omissions
•
Summaries may not capture all nuances of the original video
•
We do not guarantee the accuracy, completeness, or reliability of generated summaries
•
You should verify important information from the original video source
12.2 'As-Is' Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
13. Limitation of Liability
To the maximum extent permitted by Portuguese and EU law:

We are not liable for any indirect, incidental, special, consequential, or punitive damages
•
We are not liable for any loss of profits, data, or use
•
Our total liability shall not exceed the amount you paid for the Service in the 12 months prior to the claim
This limitation of liability does not apply to liability that cannot be excluded or limited under EU consumer protection laws.
14. Indemnification
To the extent permitted by Portuguese and EU law, you agree to indemnify and hold harmless Recapfy and its operator from claims, damages, and expenses arising from:

Your violation of these Terms
•
Your violation of any third-party rights
•
Your violation of applicable laws
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of Portugal and the European Union.
Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Portugal.
If you are a consumer in the EU, you may also have the right to bring disputes in the courts of your country of residence.
16. Changes to Terms
We may modify these Terms from time to time. We will notify you of material changes by:

Updating the "Last Updated" date at the top of these Terms
•
Sending an email notification (if you have enabled notifications)
•
Displaying a prominent notice in the app
Changes will take effect 30 days after notification. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Recapfy regarding the Service and supersede any prior agreements.
